Terms and Conditions of Use – DealBuddy

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Thinkbid Technologies Private Limited (“Company”, “DealBuddy”, “we”, “us”, “our”) and any person (“User”, “you”, “your”) who accesses, registers on, or uses the DealBuddy mobile application, website, or any associated services (collectively, the “Platform”).

By using the Platform, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must discontinue use immediately.

1. About DealBuddy

DealBuddy is India’s first gamified e-commerce platform, designed to combine shopping with interactive mechanics that create customer engagement and rewards. Users may participate in free-to-enter deals, reveal the current Golden Deal value through short ad views, and unlock rewards such as Buddy Coins, discounts, and Premium benefits.

DealBuddy is proud to be:

  • Recognized under Startup India (DPIIT Certified).

  • Supported by the Kerala Startup Mission (KSUM).

2. Eligibility

2.1 The Platform is intended for individuals who are 18 years of age or older.

2.2 Users under the age of 18 may access the Platform only with the consent and active guidance of a parent or legal guardian. By permitting a minor to access or use the Platform, the parent/guardian accepts these Terms on behalf of the minor and agrees to supervise their usage.

2.3 The Company reserves the right to verify eligibility and to suspend or terminate accounts that do not comply with this requirement.

3. Nature of Services

3.1 Participation in all Deals is free of cost. Users only pay when they choose to purchase products that they have won or claimed through the Platform.

3.2 Golden Deal Mechanics: Users may place entries during active Deals. A Golden Deal is identified as the current winning entry as per the Platform’s algorithm.

3.3 Reveals: Users may watch a short advertisement to reveal the current Golden Deal value. Each User is entitled to a maximum of five (5) reveals per Deal, with a minimum cooldown period of two (2) minutes between each reveal. Reveals are limited to the current Golden Deal and do not disclose future results.

3.4 Multiple Winners: Each Deal declares more than one winner.

  • Deal Winner (Rank 1): User with the highest number of Golden Deals, entitled to purchase the product at the Purple Price (the last Golden Deal value).

  • Purple Cap Winner: User who holds the final Golden Deal at the close of the Deal.

  • Orange Cap Winner: User who has submitted the maximum number of entries during the Deal.

  • Ranks 2 to 5: Users ranked based on Golden Deal counts, each entitled to specified discounts or benefits.

3.5 Rewards are in the form of Buddy Coins, discounts, or promotional benefits. No cash payouts are offered under any circumstances.

4. Buddy Coins

4.1 Buddy Coins are reward credits earned through participation and engagement on the Platform.

4.2 Buddy Coins are not money, are non-transferable, and cannot be exchanged or withdrawn as cash.

4.3 Buddy Coins may be applied as partial payment during eligible product purchases.

4.4 The Company reserves the right to determine how Buddy Coins are awarded, redeemed, or expired.

5. Premium Membership

5.1 Users may subscribe to Premium Membership by paying the applicable subscription fee through RBI-approved payment gateways.

5.2 Premium Membership provides benefits including:

  • Exclusive Premium-only Deals.

  • Ad-free entry to Deals (excluding sponsored ads).

  • Bonus entries in eligible Deals.

  • Free shipping on product deliveries.

5.3 Introductory or one-time trial offers may be made available (e.g., a ₹1 one-time trial).

5.4 Premium fees are non-refundable except as required under applicable law.

6. Payments

6.1 All payments for products purchased via the Platform shall be processed through secure, RBI-approved payment gateways.

6.2 Users may apply Buddy Coins toward such payments, with the balance payable through the gateway.

6.3 The Company does not store or process sensitive payment credentials (such as card details or UPI PINs). Responsibility for such data lies with the respective payment service provider.

7. User Responsibilities

7.1 Users shall not:

  • Misuse the Platform or attempt to interfere with Deal mechanics.

  • Use bots, scripts, or automated systems.

  • Engage in fraudulent, abusive, or unlawful activities.

  • Misrepresent identity or provide false information.

7.2 Any breach of this clause may result in suspension, termination, or permanent ban.

8. Intellectual Property

All trademarks, designs, software, text, and other content on the Platform are owned by or licensed to DealBuddy. Users are granted a limited, revocable, non-exclusive license to use the Platform for personal, non-commercial purposes only. Unauthorized reproduction, distribution, or modification is strictly prohibited.

9. Disclaimers

  • The Platform is provided on an “as is” and “as available” basis.

  • The Company does not warrant uninterrupted access or that the Platform will be free of errors.

  • To the fullest extent permitted by law, all implied warranties are disclaimed, including fitness for a particular purpose, accuracy, and merchantability.

10. Limitation of Liability

10.1 The Company shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, revenue, or goodwill.

10.2 The Company’s maximum liability, whether in contract, tort, or otherwise, shall not exceed the actual price paid by the User for the product purchased in the transaction giving rise to the claim.

11. Termination

DealBuddy reserves the right to suspend, restrict, or terminate a User’s account in the event of any violation of these Terms or misuse of the Platform. Users may also deactivate their account voluntarily by contacting customer support.

12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. All disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kozhikode, Kerala.

13. Amendments

DealBuddy may amend these Terms at any time. Updates will be published on the Platform. Continued use of the Platform after such updates shall constitute acceptance of the revised Terms.
